Several members of the Assembly of the People’s Representatives highlighted, with regard to the second supplementary item on the agenda of the plenary session this Tuesday and relating to the examination of the situation of deputy Ahmed Saïdani, the necessity to respect the provisions of the Constitution and the law in the procedures of interpellation.
They insisted on the need to conform to the prescribed legal framework, notably with regard to the lifting of parliamentary immunity.
They also called for respect for the provisions of Article 65 of the Constitution, in order to guarantee the protection of parliamentary immunity and the preservation of the legislative function, arguing that what happened is likely to deprive the constitutional text of its substance. In this context, they demanded the release of the deputy.
Article 65 of the Constitution provides that: “No deputy may be subjected to prosecution or be arrested during his term by reason of criminal charges, unless the Assembly of the People’s Representatives lifts his immunity. In the case of a flagrante delicto, he may, however, be arrested, provided that the Assembly is immediately informed, and detention may not continue unless the Assembly lifts immunity.”
