Article 4 provides maximum penalties that can rise to life imprisonment for anyone who is proven to have deliberately promoted or distributed drugs to minors within the school premises, as part of an organized network, as well as for any sexual assault involving a minor inside the establishment.
Article 4 likewise provides sentences ranging from 20 to 30 years in prison for offenses related to digital recruitment, extortion, recruitment of minors into criminal activities, the introduction of bladed weapons or dangerous objects, or the formation of criminal networks targeting the school environment.
These complex crimes committed against minors within educational premises are not subject to statute of limitations. Their perpetrators cannot automatically benefit from mitigating circumstances either. Parole, plea bargaining, or discontinuation of prosecution are also prohibited for offenses under this law.
Article 7 of this proposal also provides for the mandatory confiscation of all funds and assets obtained from crimes directed against the educational premises, with the possibility of extending confiscation to assets whose origin cannot be justified.
