A panel of judges from the United States Court of International Trade has approved a lawsuit filed in March by 24 states and several small businesses, challenging the legality of the tariffs imposed by the Trump administration on the majority of imports.
In a ruling issued on Thursday, a 53-page decision, the court found that the tariffs provided for by Section 122 were “illegal,” noting that they had caused “economic harm” to the plaintiffs.
The judges indicated, in the text of the judgment, that the defendants had presented no evidence justifying that they could continue to collect these illegal tariffs from importers during the entire period of their enforcement.
The Court ordered the Trump administration to cease imposing these tariffs on the state of Washington as well as on the two companies that had filed the suit. It also ordered the White House to reimburse the total amounts paid by these three plaintiffs, along with the applicable interest.
However, the Court did not issue a blanket injunction ordering the complete cancellation of these tariffs.
